OCTOBER PRESIDENT’S MESSAGE

My heartfelt thanks go to all honorable guests, past presidents, founding members, members and partners of Master Builders Association Malaysia (MBAM) for their presence and continuous support of the Association over the past years. Since I took up the presidency of MBAM, my presidential calendar was filled up with various invitations and other events to date, which have been full of exciting challenges and provided me with a lot of memorable experiences.

Some of the events include: –

NATIONAL HUMAN RESOURCES CONSULTATIVE COUNCIL (NHRCC) WORKING GROUP 4: MANAGEMENT OF FOREIGN WORKERS NO.1/2018

On 4th September 2018 at Bilik Gerakan, Ministry of Human Resource, Putrajaya was held NHRCC WG4 – Management of Foreign Workers No.1/2018 meeting. The meeting was attended by MBAM Technical Director, Ir. Chuan Yeong Ming and MBAM Assistant Manager, Muhammad Fadzley bin Salim. Item discussed in the meeting were working group term of references and issues on management of foreign workers as following:

  1. Priority for Local Employment
  2. Single Entity, Single Window and Online System
  3. Enforcement
  4. Source Countries
  5. Improvement on recruitment process

Due to time constraints, all stakeholders are given time and deadline to propose recommendations and other issues to be submitted on 10th September 2018.

SIGNING OF NOTES OF COLLABORATION BETWEEN MEMBER COMPANIES OF MASTER BUILDERS ASSOCIATION MALAYSIA (MBAM) AND POLITEKNIK UNGKU OMAR (PUO) ON 3 SEPTEMBER 2018

The Signing of Notes of Collaboration for Bachelor in Civil Engineering Technology (BCT) Work-Based Learning (WBL) Programme between members companies of MBAM and Politeknik Ungku Omar (PUO) to establish Work Based Learning (WBL) was held at MBAM Training Centre.  

The WBL programme is designed with the aim to produce human capital that meets the needs of the construction industry. The students under the programme will be exposed to real work situation during their training period with the member companies of MBAM. Among the advantages to be gained by the students are improving classroom learning with real time / hands on experience in the construction industry and increase in the understanding of the skills required for career advancement. Through the programme, the industry will also be able to establish a closer cooperative relationship with institution of higher learning.

Among the 11 MBAM’s Members of Companies  that have signed the Notes of Collaboration are Bina Puri Sdn Bhd, Sunway Construction Sdn Bhd, Trans Resources Corporation Sdn Bhd, Putra Perdana Construction Sdn Bhd, MGB Berhad, Premier Construction Sdn Bhd, Syarikat Pembenaan Yeoh Tiong Lay Sdn Bhd, Fajarbaru Builder Sdn Bhd, Trans Elite Group Sdn Bhd, Bauer (Malaysia) Sdn Bhd and Ocned Water Technology Sdn Bhd.

It is my hope that the programme can contribute to the progress of the national construction Industry. The latest 25 students will be participating in WBL 4th Cohort which will cover the duration of collaboration from 1st September 2018 – 31st August 2021.

MBAM hopes that the industry will see the benefits of this programme and more companies will join in to train the students thus contributing to a more skilled and knowledgeable work force.

MBAM SITE SAFETY SUPERVISOR (SSS) COURSE KUALA LUMPUR 70TH INTAKE  

Site Safety Supervisor (SSS) Course was held on 4th – 12th September 2018 at MBAM Training Centre. This eight (8) days competency course will qualify our participants to apply for Department of Occupational Safety & Health (DOSH) Yellow Book once they have passed all the examination conducted by MBAM which is accredited by DOSH.

Construction Industry Development Board (CIDB) contractors will be eligible to earn 20 Contractor Continuous Development (CCD) points with this SSS course.

MBAM COCD PROGRAMME MELAKA ADDITIONAL CLASS

On the 4th September 2018 at MBCA Melaka was held an additional class for all participant of COCD Melaka 2nd Intake. The objective of the class was to have a peer to peer discussion and complete all of their assignments.

Participants of COCD Melaka 2nd intake would have to prepare for their presentation of assignments and they will be evaluated on the 13th September 2018 at MBCA Melaka.

THE 46TH ASEAN CONSTRUCTORS’ FEDERATION (ACF) COUNCIL MEETING, 7TH SEPTEMBER 2018

The 46th ASEAN Constructors’ Federation (ACF) Council Meeting was chaired by the Indonesian Contractors Association (ICA) successfully hosted by the Thai Contractors’ Association (TCA) on 7th September 2018 at Impact Convention and Exhibition Centre in Bangkok.  MBAM was represented by MBAM Immediate Past President and IFAWPCA President, Datuk Matthew Tee, MBAM Deputy President, Tan Sri Dato’ Sri Sufri Haji Mohd Zin and myself who are also the ACF Council members representing MBAM.  Also present were MBAM Past Deputy President, Mr Aziz Bahaman, MBAM Council Member Datuk Astaman and MBAM Assistant General Manager, Ms Loh Mei Ling.

The meeting was chaired by Mr Joseph Pangalila and assisted by ACF Secretary General, Mr Adrianus Hadiwinata. ACF Secretary-General, Mr. Adrianus Hadiwinata presented the ACF Secretary-General report and this was followed by the Treasurer’s Report and Approval of the Interim Financial Report as of 31st August 2018 which was presented by ACF Treasurer-General, Mr. Desmond Hill. At the break, ACF members visited the INTERMAT ASEAN exhibition. Matters arising included:

  1. Signing of Amendment of the ACF Constitution
  2. Draft of Manual of Standard of Procedures for the host Country
  3. ACF Website progress report

MBAM Secretary-General, Mr Eric Yong presented the country report on behalf of MBAM. MBAM also took the opportunity to present the 44th International Federation of Asian and Western Pacific Contractors Associations (IFAWPCA) Convention promotion video to the ACF delegates and invited them to participate in the convention schedule from 12th – 16th November 2018 in Kuala Lumpur, Malaysia.

The Cambodian Contractor Association (CCA) has agreed to host the 47th ACF Council Meeting in Myanmar.

At the closing MBAM Deputy President, Tan Sri Dato’ Sri Sufri Hj. Mohd Zin presented souvenirs to TCA as host and to the ICA for chairing the meeting.

MBAM COURTESY VISIT TO YANG BERHORMAT TUAN BARU BIAN, MINISTER OF WORKS, MALAYSIA

On 7th September 2018, I led a delegation to pay a courtesy visit to Minister of Works, Yang Berhormat Tuan Baru Bian at Menara Kerja Raya.  In attendance were MBAM Vice President, Mr Dennis Tan & YBhg. Dato’ Ubull Din Om, MBAM Treasurer General, Mr Kenneth Liew, MBAM HR Committee Member, Mr Mazlan Haron, MBAM Executive Director, Ms Loh Mei Ling and MBAM Manager, Mr Mohd Farhan Mohammad Din. The issues discussed were on Managing Foreign Workers, Accreditation of Skilled Workers, the government policy in awarding a contract, and the business concern on GST output tax as well as the impact of SST on construction industry were raised to YB Minister.

During the engagement with YB Minister, I took the opportunity to promote the upcoming 44th IFAWPCA Convention and invited YB Minister to be the Guest of Honour for the Opening Ceremony of the 44th IFAWPCA Convention which is scheduled to be held on 13th November 2018.

ACCCIM JOINT MEETING ON FOREIGN WORKER ISSUES

The ACCCIM Joint Meeting on Foreign Worker Issues was held on 12th September 2018 at 11.00 am attended by MBAM Vice President cum Chairman of MBAM HR Committee, Mr Dennis Tan, MBAM HR Committee Member, Mr Mazlan Haron, and MBAM Manager, Mr Mohd Farhan Mohammad Din.

The meeting discussion focused on the matters on Transparent, Practical Foreign Worker Management System and issues in relation to the suspension of the Recruitment of Bangladeshi Foreign Workers (FW) via Sistem Pengurusan Pekerja Asing (SPPA) by Kementerian Dalam Negeri (KDN). The suspension has cast policy uncertainty and caused disruptions to business operations as Bangladeshi is one of the main sources of foreign workers.

IFAWPCA PRESIDENT COURTESY VISIT TO ASIAN DEVELOPMENT BANK, MANILA

On 18th September 2018, IFAWPCA President, Datuk Matthew Tee and his team members IFAWPCA Secretary General, Ir. Chuan Yeong Ming, IFAWPCA Executive Director, Mr Levy V. Espiritu, IFAWPCA Chief Operating Officer, Mr Ibarra P. Paulino, IFAWPCA Contracts Officer, Ms Anne B. Rao, MBAM Executive Director, Ms Loh Mei Ling and MBAM Senior Manager, Ms Lee Siew Mei paid a courtesy visit to the Asian Development Bank, Manila.  The IFAWPCA delegation was received by Mr Ashraf Mohammed, Deputy Director General, Office of the Director General, Procurement, Portfolio & Financial Management Department and his team members, Mr Jesper Pedersen and Mr Rustam Abdukayumov. Mr Ashraf Mohammed gave a brief introduction on the role and functions of the Asian Development Bank.  Whilst Datuk Matthew Tee gave a short brief about the IFAWPCA’s history and role in the Asian and Western Pacific region. 

The meeting discussed on the following issues/maters:

  1. Review on the Performance Bond amount.
  2. Security of Payment Legislation e.g. CIPAA.
  3. Promotion of Joint Venture between Foreign and Local Contractors.
  4. FIDIC Contracts – proposed amendment to some of the clauses.
  5. Bangladesh (BACI) extends their appreciation to ADB for the “Skills for Employment Investment Programme”.
  6. IFAWPCA’s desire to work closely with ADB on policy matters affecting the delivery of development projects.
  7. Request ADB to consider to give grant to the Asean Constructors’ Federation (ACF) to obtain proper reports on the development of the Asean countries’ report.
  8. IFAWPCA invitation to ADB to participate in the coming 44th IFAWPCA Convention to be held from 12th – 16th November 2018 in Kuala Lumpur Convention Centre and for them to participate & brief IFAWPCA members in the Contracts Committee on the new policies of ADB relating to project developments.

 

The meeting ended with IFAWPCA President, Datuk Matthew Tee presenting a memento to Mr Ashraf Mohammed of ADB.

MBAM TALK ON CONCRETE REPAIR & WATERPROOFING CHALLENGES

MBAM Talk on Concrete Repair & Waterproofing Challenges was held on 24th September 2018 at MBAM Training Centre.  The training was officiated by MBAM Chairman of Technical & IBS Committee, YBhg. Datuk Kow Choong Ming, and attended by Deputy Chairman of Technical & IBS Committee Member, Mr Nalla Sundran and MBAM Manager, Mr Mohd Farhan, attracted 60 participants.

This talk was organized by MBAM Technical & IBS Committee to enhance the knowledge on post-construction matters (building/bridges) for concrete repair work. It is also the aim of MBAM to convey the latest technology & development on concrete repair work & waterproofing to our members through this talk. 

The paper was presented by Mr. Philippe Stoll and Ir. Steven Ng.

Below are the topics discussed in the talk:

  • Introduction – What is classified as defect, Types of defect and early symptoms related to concrete repair and the challenges of waterproofing.
  • Waterproofing – Built Structure Problem Common issue on swimming pool and roof top leaking, Expansion joint in between old and new building, Basement Injection, Common mistake during application/ workmanship etc., and Latest product development.
  • Concrete Repair – Definition, Types of repair on RC, Which repair method is suitable for defect types, Common mistakes during application / workmanship, Latest product development for Repair.
  • Strengthening – Definition, Types of Strengthening by using SIKA Software Calculation, Which method is suitable for strengthening types, Common mistakes during application or workmanship etc,  Latest product development for Strengthening.

MALAYSIAN CONSTRUCTION INDUSTRY EXCELLENCE AWARDS (MCIEA) 2018

The Construction Industry Development Board Malaysia (CIDB) celebrated the achievements of 29 industry players at the Malaysian Construction Industry Excellence Awards (MCIEA) 2018. This year’s Awards was the first time for one company namely, WCT Berhad, to take home two major  accolades – “ Builder of the Year Award” and the “International Achievement Award” for the Ministry of Interior Headquarters at Wadi Al-Sail, Qatar.

WCT also took home the “Green Building Award (Non-Residential)” for the Ministry of International Trade and Industry headquarters.

Other awards presented include a “Best Project Award — Building (Major)” to IJM Construction Sdn Bhd for the Damansara Uptown Retail Centre (Starling Mall) and an “International Achievement Award (Special Mention)” to Eversendai Corporation Bhd for various buildings such as an International Convention Exhibition Centre in India.

In addition, the “Best Project Award (Infrastructure) — Small” went to Sunway Construction Sdn Bhd for the Sunway Velocity Link Bridges, as well as “Best Project Award (Building) — Major (Special Mention)” to Pembinaan Mitrajaya Sdn Bhd for the Malaysian Anti-Corruption Commission headquarters in Putrajaya.

At the event, I was presented an award for “CEO of the Year Award and “Construction Leading Lady” awards was given to Executive Director of YTL Corporation Bhd, Datuk Yeoh Soo Keng

The guest of honour at the MCIEA 2018 award ceremony was Works Minister, YB. Tuan Baru Bian. Also present at the event was Deputy Works Minister, Tuan Mohd Anuar Tahir and CIDB Chairman Tan Sri Ahmad Tajuddin Ali.

PRE-COUNCIL JAWATAN KUASA BEBAS PENGURUSAN PEKERJA ASING BERSAMA STAKEHOLDER MEETING BY ILMIA, MOHR

The meeting was hosted by Institute of Labour Market Information and Analysis (ILMIA)  and held on 19th September 2018 at Bilik Mesyuarat Utama ILMIA, Cyberjaya. The meeting attended by MBAM Deputy Chairman of Human Resources Committee, Datuk Astaman Abdul Aziz, MBAM HR Committee Member, Mr Mazlan Haron, MBAM Manager, Mr Mohd Farhan and MBAM IT & Admin Assistant Manager, Mr Muhammad Fadzley.

The memorandum from MBAM and other industries was sent to ILMIA for compilation and will be addressed to the committee for consideration.

DISCUSSION ON PROPOSAL OF MANAGEMENT OF FOREIGN WORKERS

On the 20th September 2018 a meeting was held at Tan Sri Datuk Tee Hock Seng Conference Room on proposal of management of foreign workers for Institute of Labour Market Information and Analysis (ILMIA).

MBAM compiled the related issues relation to the proposal on management of foreign workers to be summitted to ILMIA. The issues and proposal are related to employers’ responsibility and several items such as Quota System for Acquiring Foreign Workers, Replacement Quota of Foreign Workers, Process Acquiring Foreign Worker, Comprehensive One Single System, Definition of Wages, Registration of The Movement of Workers, Foreign Worker More Than 10 Years Services with RM10k Levy, Levy Payment, Rehiring Programme and etc.

The proposal was submitted to ILMIA on 26th September 2018.

PIKOM ANNUAL DINNER AND ICT AWARDS NIGHT 2018

On the 21st September 2018 at Majestic Hotel, Kuala Lumpur the PIKOM Annual Dinner and ICT Award Night 2018 was attended by MBAM Vice President and Publication and ICT Chairman, Mr Steven Shee and MBAM IT & Admin Assistant Manager, Mr Muhammad Fadzley bin Salim.

The Minister of Entrepreneur Development, YB Tuan Mohd Redzuan Md Yusof was the Guest-of- Honour.

44th IFAWPCA CONVENTION PROMOTIONAL VISIT TO TAIWAN GENERAL CONTRACTORS ASSOCIATION (TGCA)

International Federation of Asian and Western Pacific Contractors’ Associations (IFAWPCA) President, Datuk Matthew Tee led a delegation for a courtesy visit to the Taiwan General Contractors Association (TGCA) on 21st September 2018. Together in the delegation were MBAM Vice Presidents, Mr. Oliver Wee and Dato’ Ubull Din Om, MBAM Treasurer General, Mr Kenneth Liew, MBAM Secretary-General, Mr Eric Yong, MBAM Deputy Secretary-General, Mr Ong Ka Thiam, MBAM Council Members who attended  were Mr Alec Chong and Mr Wilson Ang and MBAM Honorary Advisor (Legal), Mr John Tong.

The delegation was well received by TGCA President Mr. Chiang Chi-Ching, TGCA Secretary-General, Mr Chen Fu-Tien, TGCA Chairman Mr. Chen Shih-Han, TGCA International Affairs Coordinator, Mr Hsieh Ming-Ta.

The main purpose of the visit was to promote the 44th IFAWPCA Convention which will be held from 12th-16th November 2018 at Kuala Lumpur Convention Centre (KLCC) hosted by Master Builders Association Malaysia (MBAM).  As the IFAWPCA President, Datuk Matthew Tee briefed and updated TGCA on the detailed Programme of the Convention.

MEETING ON TRAINING COLLABORATION BETWEEN CIDB AND MBAM

On the 25th September 2018 at Tan Sri Datuk Tee Hock Seng Conference Room a meeting was held on training collaboration between CIDB and MBAM. CIBD would like to include Construction Industry Standard (CIS) as one of module in the COCD Programme. This is an initiative from CIDB to give awareness to contractors on Quality Assessment System for Building Construction Work (QLASSIC) and For Roadworks will be included in the module of COCD programme. The meeting concluded that MBAM will restructure and revise a module from COCD programme and emphasis on CIS.

The COCD programme and supervisor accreditation is also being clarified during the meeting. COCD participants will be awarded the Malaysian Skills Certificate (SKM) level 3 which is equivalent for trade foreman supervisor category. However, a site supervisor will be accredited and awarded Perakuan Kecekapan Penyeliaan Pembinaan (PKP) by CIDB after going the process of accreditation. Therefore, a supervisor who attend the COCD programme must attend the accreditation process to be accredited supervisor and comply with CIDB Act 520 (Amendment 2011).

JOINT MEETING OF INDUSTRY ASSOCIATIONS TO DISCUSS PROPOSAL FOR EMPLOYER TO PAY RM10,000 LEVY TO EXTEND EMPLOYMENT OF SKILLED FOREIGN WORKER BEYOND 10 YEARS

On 28th September 2018, a meeting was held at MEF Headquarters Petaling Jaya to discuss  the RM10, 000 proposed levy to extend employment skilled foreign worker beyond 10 years. MBAM Vice President, Mr Dennis Tan and MBAM Senior Manager, Ms Lee Siew Mei attended the meeting.

The Joint Industry Associations decided to prepare proposal on the payment on yearly basis of the levy such as RM10, 000 for three years, for employer is RM 5,550.00 as levy for three years and for employee (foreign worker) is RM 4,450.00 as a levy for three years.

REHDA’S CEO SERIES

On 24th September 2018, I was invited to speak at REHDA Institute’s Annual Property Developers Conference, CEO Series 2018. More than 600 senior property developer personalities and business leaders from related industries attended the conference. A total of 18 speakers and 3 panel discussion sessions  were there to discuss how can stakeholders work together in stimulating and rebuilding the economy post GE14, how to attract investments into Malaysia as well as looking at new solutions to overcome the issue to unsold property units in Malaysia.

TROX MALAYSIA SDN BHD – NEW FACTORY OFFICIAL OPENING

On 25th September 2018, Mechanical & Electrical (M&E) Committee were invited to attend the official opening of new factory at Taman Perindustrian Senawang, Seremban, Negeri Sembilan.  M&E committee members who attend the new factory official opening ceremony include Mr. Tony Kok, Mr. Gan Wah Lien, Mr. Vincent Lim, Mr. Lee Ah Nam and MBAM Assistant Manager Mr. Leon Leong.  The opening ceremony followed by a dinner at Hotel Royale Chulan, Seremban.

MBAM CSR 2018 – HOME FOR LIFE

MBAM Publications & Outreach Committee successfully organised the MBAM CSR Activity for 2018 in conjunction with the Malaysia Day on 28th to 30th September 2018. The participation of 67 men and women from 17 MBAM member companies and from MBAM Secretariat for CSR Programme – Home for Life. The event started with a one day builders’ workshop for the participants which was held on 22nd and 23rd September 2018 at Bandar Sunway. The builders’ workshop introduced the participants to the power tools and concluded with the participants building a simple furniture using the skills gained.

The CSR activity was held at the Kampung Orang Asli Sungai Lalang, Semenyih, where the participants were divided into two groups to build the two new houses for the Orang Asli families. The first build site was located on a slope and the house was intended for the family of Mr George. The second build site was located on a flat land and the house was intended for the family of Mr Roslan. All the participants started working on the two houses as soon as they arrived at the sites in the early morning of 28th September 2018.

After three days of hard work, both houses, were successfully completed and handed over to both families on the 30th September 2018.

MBAM is proud to be part of this CSR initiative which have contributed to raising the living standards of both Mr George‘s and Mr Roslan’s families and we hope to continue with such CSR initiatives in the future with the support of our Members and business associates.

DIGITAL CONSTRUCTION SUMMIT

On the 29th September 2018, the Digital Construction Summit was held at Sheraton Hotel, Petaling Jaya. The keynote speaker, Minister of Works YBhg. Dato’ Massuan Ahamad, Special Officer, spoke on New Malaysia: Exploring the Future of Architecture, Engineering and Construction (AEC) Industry. The Malaysia BIM contest 2018 Award was given during the summit as well.

The summit was attended by MBAM Vice President and Publication and ICT Chairman, Mr Steven Shee and MBAM IT & Admin Assistant Manager, Mr Muhammad Fadzley bin Salim.

CONTRACTS & PRACTICES PROGRAMME 5: LOSS AND EXPENSE

The above programme was held on 27th September 2018 at MBAM Training Centre. MBAM Assistant General Manager, Mr. Lenny Lim delivered a welcome speech on behalf of MBAM Vice President and Chairman of Contracts and Practices Committee, Mr Oliver Wee and welcomed the participants to the 5th of the 9 Sessions of Practical Construction Contract Administration/Management based on 48 BK ENTRUSTY Articles published in MBAM Journal from 2002 to 2016 written by Managing Director of BK Entrusty and MBAM Contracts and Practices Committee Member Sr. Ong Hock Tek.

The programme was conducted by Mr HT Ong and was attended by 56 pax.

Construction contracts  generally provides contractors to claim direct loss and/or expense as a result of the progress of the works being materially affected by relevant matters for which the client is responsible such as failure to give the contractor possession of the site, failure to give the contractor access to and from the site, delays in receiving instructions, opening up works or testing works that then prove to have been carried out in accordance with the contract, discrepancies in the contract documents, disruption caused by works being carried out by the client, failure by the client to supply goods or materials, instructions relating to variations and expenditure of provisional sums and inaccurate forecasting of works described by approximate quantities.

The programme was interesting and gave participants a change to clarify matters with regards to the topic of loss and expenses.

COURTESY VISIT BY PENANG MASTER BUILDERS & BUILDING MATERIALS DEALERS ASSOCIATION (KIM TIN SEAH)

On 27 September 2018, Penang Master Builders & Building Materials Dealers Association (KIM Tin Seah) (PMBBMDA) paid a courtesy visit to Master Builders Association Malaysia (MBAM).

The representatives from PMBBMDA were led by President, Dato’ Lim Chee Tong, Immediate Past President, Mr. Alvin Yeow.

Representatives from MBAM included Vice President, Mr. Dennis Tan Soo Huang and Mr. Steven Shee Boo Cheong, Deputy Secretary-General I and Council Members.

The meeting was fruitful with both sides updating on the current issues. We hope that we may work together for the betterment of the industry.
