NOVEMBER 2012 MESSAGE FROM MBAM PRESIDENT, MR MATTHEW TEE
The Construction Industry Payment and Adjudication Act (CIPAA) was gazetted on 22nd June 2012 and the Master Builders Association Malaysia (MBAM) wishes to thank the Government for the enactment of this statute. The CIPAA has been long awaited by the construction industry to address the pervasive prevailing payment problems. Towards this end, MBAM calls upon the Honorable Works Minister to announce the taking effect and enforcement of the CIPAA soonest possible, preferably in the beginning of 2013.
In line with the impending coming into force of the CIPAA, MBAM also calls upon the Government to establish the specialist construction court. At the recent briefing organized by the Construction Industry Development Board, Malaysia (CIDB), it is clear from the United Kingdom experience that the successful implementation of the CIPAA will be critically dependent on robust, efficient and expert court support. The proposal to establish the specialist construction court is the joint initiative of the CIDB and the Bar Council Malaysia. The Master Builders Association Malaysia fully supports this initiative for the betterment of the Malaysia construction industry as envisaged in the Construction Industry Master Plan (CIMP) to help the construction industry to move forward by achieving global standards. CIPAA provides for adjudication. CIPAA if supported by a specialist construction court will strengthen the administration of justice in a speedy and economical way.
MEMORANDUM TO DEWAN BANDARAYA KUALA LUMPUR (DBKL) AND PEMUDAH
MBAM and REHDA has sent a joint a memorandum to DBKL where we are proposing measures in the area of construction which we believe will reduce the complaints from the city dweller while allowing the developers and construction professionals for the installation of first class infrastructure and facilities in the shortest period possible. The memorandum stressed on a need for clearly laid down rules whose criteria are measurable and transparent for which there will be strict enforcement to help alleviate most of the problems currently faced by all parties including enforcing agencies, city dwellers and contractors.
