REMINDER: SELF-DECLARATION ON WORKERS ACCOMMODATION DETAILS AND MEDIA STATEMENT ON THE LATEST AMENDMENT TO THE ACT 446 UNDER EMERGENCY ORDINANCE
MBAM would like to remind Members that under the requirement of Section 24E of the Workers’ Minimum Standards of Housing and Amenities Act 1990 (Act 446), all employers who are providing accommodation to their workers are required to notify the Department of Labour (JTK) on the living condition of their accommodation. Any offences to the Act will be compounded not more than RM10,000.00.
Members are urged to complete the enclosed form ‘Self-Declaration Penginapan Pekerja Di Bawah Seksyen 24E Akta 446” if you have not done so and submit to the nearest Department of Labour State Office or by email to jtksm@mohr.gov.my. Further information is also available at www.jtksm.gov.my.
Further to the above, MBAM would also like to remind Members on the enforcement of the Latest Amendment to the Act 446 under the Emergency Ordinance. The Department of Manpower (JTK Semenanjung Malaysia) together with the relevant authorities such as CIDB will be gearing up their operations at Construction sites to check on the compliance of the Act 446. Any employers who are found not compliance with the Amended Act 446 will be resulted in a hefty penalty of fine up to RM200,000 or up to 3 years jail or both.
