NOTICE OF ENFORCEMENT OF OCCUPATIONAL SAFETY AND HEALTH (CONSTRUCTION WORK) (DESIGN AND MANAGEMENT) REGULATIONS 2024 (CDM 2024 REGULATIONS)
For members’ information, the Occupational Safety and Health (Construction Work) (Design and Management) Regulations 2024 (CDM 2024 Regulations) was enforced on 1 June 2024 as part of the national occupational safety and health legislative framework for the construction industry.
Taking into consideration feedback received from the industry through a series of workshops and engagement sessions, as well as the level of preparedness of duty holders in understanding and complying with the requirements of these Regulations, the Department of Occupational Safety and Health (DOSH) has decided to extend the phased enforcement approach through “Soft Enforcement” for Part II and Part III of the CDM 2024 Regulations until 1 January 2027. However, Part IV and Part V of the CDM 2024 Regulations will continue to be subject to full enforcement by DOSH.

Accordingly, with effect from 1 January 2027, all duty holders subject to the CDM 2024 Regulations shall ensure full compliance with their respective duties and responsibilities, including the appointment of duty holders, provision of pre-construction information, safety and health planning, coordination among duty holders, management of risks at the design stage, and the preparation of related documents as required under the CDM 2024 Regulations.
Throughout the “Soft Enforcement” period, the Department’s approach will focus on compliance assistance, advisory services, technical engagement sessions, document reviews, improvement directives, and capacity-building initiatives for stakeholders, particularly within the construction industry. In line with this approach, the CDM Documentation Preparation Guidelines, which are expected to be completed by July 2026, are intended to serve as a key reference to assist the industry in preparing CDM documents in a clearer, more consistent, and systematic manner. This will further support the phased, practical, and structured implementation of the CDM 2024 Regulations prior to full enforcement.
