Q&A Tell us about your entry submission experience. We found that the entry criteria imposed for participation in the CITA award to be very extensive and stringent. Submissions involved extensive documentation and a write-up to attest our capability as a competent professional and reliable foundations contractor. What kinds of improvements would you like to see in your area of expertise? We would like to see the introduction of innovative solutions and products to the industry, which will make difficult projects possible to be constructed, are economically more viable and has less impact to the environment. Any other thoughts on the award you would like to add? Perhaps to consider evaluating a contractor’s capability based on a current project that demonstrates the evaluation criteria. JUDGING & ASSESSMENT Judging is a difficult task, but having a set of criteria combined with point weightage made it easier to evaluate and decide. The five key areas assessed are company performance (25%), technical capabilities (35%), adoption of best practices (20%), recognition (10%) and other contributions (10%). An interview was conducted with each participant to clarify their submissions following their hardcopy submissions. Bauer was selected as the winner of this category, as the company showed outstanding performance in certain areas while being extremely competitive in others. The winning push came mainly from company performance as well as technical capabilities, which formed 60% of the evaluation. Due to the variety of products of ground engineering works they were able to execute, they have demonstrated their versatility and flexibility in proposing various optimum solutions either in design or execution methodology, adapting to ground and project requirements specific to each project. Notable among their accomplishments were the deepest diaphragm wall going to a depth of 80m with a wall thickness of 1.5m, produced with their very own Bauer Cutter Technology and their 2.5m diameter bored piles with a staggering depth exceeding 130m. Their maintenance of an order book, which somehow balanced private and government projects, also showed their competitiveness in the current challenging market. Thomas Domanski receiving award for Bauer (Malaysia) Sdn Bhd, winner of the piling contractor category 28 MASTER BUILDERS JOURNAL #11630 MASTER BUILDERS JOURNAL #116 Industry & Practices IP 23 JULY 2019 Syarikat Jaminan Pembiayaan Perniagaan Berhad (SJPP) Talk on Government Guarantee Schemes for SMEs The talk conducted by SJPP, a wholly owned company under Ministry of Finance Incorporated, was organised after MBAM’s courtesy visit to the office of Deputy Secretary of Commercial Sector, under the Government Investment Division, Ministry of Finance on 19 March 2019. The main aim is for member to have a better understanding of each of the guarantee schemes under SJPP. MBAM Treasurer-General cum Chairman of Finance Committee, Kenneth Liew delivered the welcome remarks, where he introduced and thanked Masliza Zainal Abidin, Senior Manager, Guarantee Schemes Management in SJPP; as well as Alvin Ang and Anita Tang from HSBC Bank for sharing their knowledge on the government guarantee schemes to members. Also present were Vice President, Dennis Tan and council member cum Finance Committee Deputy Chairman, Tan Zi Ni, and the secretariat staff. The scheme is opened to SMEs with viable businesses that have been in operation for six months to two years. The definition of SME is stipulated in the ‘Guidelines for SME’ issued by SME Corporation Malaysia, and endorsed by the National SME Development Council. To qualify as an SME, either sales revenue or the number of full- time employees of a business is used as a yardstick. A company in the non- manufacturing sector with an annual sales turnover of not exceeding RM20 million or have full-time employees of not exceeding 75 employees qualify as an SME while a company under the manufacturing sector qualifies as an SME if they have an annual sales turnover of below RM50 million or have full-time employees not exceeding 200 workers to qualify as an SME. Another eligibility criterion is that Malaysians must hold minimum 51% shareholding of the company. Masliza also elaborated on guarantee schemes managed by SJPP. She explained the salient features of the scheme that included purposes of financing such as for working capital and capital expenditure, as well as the guarantee fees for the 70% guarantee coverage. The type of facilities available ranges from Term Loan/Term Financing, Overdraft/Cash Line-I, Trade Facilities & Commercial Card in addition to the rebate incentives offered by SJPP. Applications from SMEs with good credit profiles who meet the general application criteria but without collateral or security will be submitted for SJPP evaluation by the financial institutions. Once an application is approved, SJPP will provide a guarantee to the financial institution for the lending of money to the successful SME. A Q&A session was also held. The second speaker, Anita from HSBC briefed on information required, i.e. a company’s capability, past records, risk assessment, and foreign exchange. Flashback 19 March 201931 MASTER BUILDERS JOURNAL #116 24 JULY 2019 Launching of the 2019 OECD Economic Survey of Malaysia Income Tax (Deduction for Employment of Senior Citizen, Ex-convict, Parolee, Supervised Person and Ex-drug Dependant) Rules 2019 The Digital Service Tax (DST) will be implemented with a digital tax rate of 6%, which shall be charged and levied on any digital service provided by a foreign registered person (FRP) to any consumer in Malaysia. The Royal Malaysian Customs Department (RMCD) has, on 20 August 2019 published ‘Guide On: Digital Services’, the contents of which includes the implementation of service tax on digital service, the registration requirements and accounting for tax and transitional rules. Definitions of Digital Service, Consumer, Foreign Registered Person (FRP), Designated Areas, Special Areas and Foreign Service Provider (FSP) are given. FSP, who provides digital services to consumers in Malaysia is mandated to be registered as an FRP if the total value of digital services provided for a period The 2019 Organisation for Economic Co-operation and Development (OECD) Economic Survey of Malaysia was launched at Jabatan Kemajuan Islam Malaysia (JAKIM). Deputy Secretary- General, Masamichi Kono presented the survey during the launch. The 2019 Economic Survey of Malaysia projected resilient growth for the nation’s economy but cautioned that there are social and governance risks that must be addressed. It analysed the factors underpinning the country’s successful economic performance, as well as the need for new policies to address social and governance challenges. The survey discussed reforms to ensure fiscal sustainability, strengthen integrity, improve skills acquisition and social opportunities, raise productivity and make growth greener. It predicts that private consumption will continue to be the main driver behind the nation’s growth due to stable employment conditions and Putrajaya’s measures to help low-income families. The above was gazetted on 11 June 2019 to provide further deduction to employers whose source of income is from business only. There shall be allowed as a deduction the remuneration of the kind allowable under Section 33 of Income Act, 1967 for years of Assessment 2019 and 2020, who is a citizen of Malaysia and resident in Malaysia, from amongst the following: • A senior citizen who shall be sixty years and above; • An ex-convict who is a person convicted for any offence by a court and had served his sentence of imprisonment; • A parolee as defined in the Prison Act 1995 [Act 537]; • A supervised person who is a prisoner directed by an officer-in- charge to work at such labour under Steven at the launch subparagraph 47 (1) (b)(iii) of the Prison Act 1995; or • An ex-drug dependant (as defined in the Rules) Conditions for deductions are: • the employee is employed on a full- time basis with remuneration that does not exceed RM4,000 • the employee and employer are not the same person • the employee is not a relative of the employer (as defined in the Rules) • the employer must produce a written confirmation from the Malaysian Prison Department or the Malaysia Anti-Drugs Agency confirming the status of the employee. Mohd Zin; Vice President, Oliver Wee; Council Member, Ir Anthony Teoh and the MBAM secretariat were at hand to greet the delegation from the National Public Procurement Agency of Indonesia (NPPA). The objective of the visit is to set a benchmarking study on the government procurement system related to the construction sector with its ASEAN neighbours. The meeting covered standard form of contracts in Malaysia, the Construction Industry Payment and Adjudication Act (CIPAA), the introduction of construction courts, and also the mediation services offered by MBAM to resolve disputes related to construction contracts. Other items discussed were on how tenders involving foreign contractors were handled in Malaysia, and opportunities for Malaysian contractors in Indonesia following the news of the relocation of its capital to Kalimantan. Ho 16 JULY 2019 Meeting with the Chartered Institute of Building Malaysia (CIOB Malaysia)36 MASTER BUILDERS JOURNAL #116 Visits & Dialogues VD 29 JUNE 2019 MBAM Focus Group Dialogue The annual MBAM Focus Group Dialogue (the dialogue) was held before the convening of the MBAM Annual General Meeting (AGM). The dialogue is one of the platforms for members to raise issues affecting them and the industry and to share their experiences dealing with such issues concerning the industry. The dialogue was held at Sunway Resort Hotel and Spa with MBAM President Foo Chek Lee thanking the attendees on behalf of the council, for taking time off to attend the dialogue. MBAM Human Resources Committee Member, Mazlan Haron was at hand to give an overview on hiring of new foreign workers that involved 36 processes starting from Job Clearing System (JCS) application in the Foreign Workers Integrated Management System (ePPAx) until repatriation (Check-out Memo). Members were informed that the Ministry of Home Affairs had reinstated the foreign workers replacement scheme through Check out Memo (COM) through its 24 June 2019 circular, which took effect on 1 July 2019. The COM allows employers to obtain replacement for foreign workers without having to go through new applications. However, the employer is subject to an audit process that, in some cases, could take more than two months. The audit included an assessment on compliance with existing labour laws and employers substantiating their compliances with documentary proof, especially for employees whose salaries are RM2,000 and below. In the event where applications are rejected, the applicants are given a 30-day period to appeal as well as to ratify such non- compliance issues. Mazlan advised members present to adhere strictly on computation of overtime based on labour law and to keep proper records. The interview session for KDN Quota application for the construction industry is conducted by Agensi Kawal Selia (AKS) on a weekly basis at the One Stop Centre in KDN Office Putrajaya. Mazlan also briefed on the Ministry of Human Resources’ proposed amendments to labour legislation, which are the Employment Act 1955, Trade Unions Act 1959 and the Industrial Relations Act 1967. Many of the proposed amendments are significant and will have a potential impact on the cost of doing business and on the labour market. Other issues raised related to foreign workers were on the re-hiring programme and on shortage of workers. Members were informed that the re-hiring programme has ceased and members of the G1-G3 categories may apply for foreign workers through CLAB for a 6-month employment period. However, it is only applicable for Peninsular Malaysia. MBAM shared that CIDB is now in the midst of introducing a new green card with an embedded chip and will be linked to the Immigration Department. It was noted that many contractors obtained their workers through agents who are not registered with CIDB, hence their workers are unable to get CIDB green cards, and workers without CIDB green cards cannot work at construction sites. On the recent increase in cement price, MBAM informed that this issue was already dealt with by the Ministry of Domestic Trade and Consumer Affairs (MoDTCA) and there will not be any increase in cement price, as any increase will require the MoDTCA’s approval, since it is a controlled item. Issues and challenges faced by small contractors including difficulties in securing projects, increased cost of doing business and low local contents in projects were conveyed during courtesy visits to the Prime Minister and Finance Minister in the first quarter of 2019. The government responded positively with an increase of local contents to 40% from 30% for projects and reduced the foreign worker levy from RM10,000 to RM6,000.00 for each foreign worker who has worked for more than 10 years in the construction industry. Members also shared their experience in dealing with foreign workers who absconded, met with accidents and whose passports went missing. The labour laws in Sabah and Sarawak differs from Peninsular Malaysia, thus it is hoped that the amendments on labour legislatures will be streamlined. On the question of sub-standard mesh, President Foo advised that all construction materials must be approved by CIDB Malaysia under the existing CIDB regulation Quality Material Control in the Act 520. Those who use sub-standard construction materials will be penalised under the said Act. MBAM is supportive of the Industrial Building System (IBS) and is working closely with CIDB Malaysia. It has requested CIDB Malaysia to incentivise contractors who are engaged in activities related to modular construction, including lifting and Building Information Modelling (BIM) software. The matter to reduce import duties on new cranes from other countries other than from Japan and China was also brought to the attention of Minister of Finance (MOF). The MOF responded by granting a three-year grace period for reduction of import duties from other countries. MBAM will continue to highlight issues affecting the construction industry through meetings, consultation or dialogues with the relevant authorities. 05 JULY 2019 Meeting with Institute of Labour Market Information and Analysis (ILMIA) The objective of the meeting with ILMIA was to discuss human resource matters, which covers the foreign workers replacement quota system via Check Out Memo (COM), the amendments to labour laws, and the proposed multi-tier levy system. It is noted that the reinstated multi-tier system is more complex in terms of the application process and is time consuming. Hence, the implementation of the multi-tier system is self-defeating.
