SURVEY ON WORKERS ACCOMMODATION – ISSUES ON GETTING APPROVAL FROM LOCAL COUNCILS / PBTS AND LABOUR DEPARTMENT / JTK
The Workers’ Minimum Standards of Housing and Amenities Act 1990 (Act 446) were passed in the Dewan Rakyat on 15 July 2019, and Dewan Negara on 31 July 2019, and subsequently gazetted on 18 September 2019 with the aims to improve the Guidelines for the Foreign Workers’ Accommodation 2018, prepared by the Department of Labour Peninsular Malaysia, which covers the standard of minimum living space, basic facilities for homes and workers as well as elements of safety and hygiene that should be emphasised by the employer. This includes the prevention of the Covid-19 virus. The date of the enforcement was announced on 27 May 2020 providing employers a three month grace period to comply and the full enforcement came into operation since 1 September 2020 and shall apply to all employers and centralized accommodation providers with fines of RM50,000 for each offence. Besides Labour Department/JTK, the application will also involve certain approvals from the Local Councils/PBTs.
Further to this we are conducting this survey among members on the issues with Local Councils / PBTs and Labour Department / JTK in obtaining Certificate for Accommodation (CFA) which comply with Act 446.
