Transfer pricing continues to be the focus area in tax audits, especially for businesses engaged in property development, construction and allied activities, with increasing scrutiny on financial assistance arrangement and intragroup services. The new TP Rules 2023 have made the standards more stringent, with serious penalty implications for non-compliance. Capital Allowance study involves a detailed scrutiny of the capital expenditure incurred to enhance the value of capital allowances claim. Understanding of the tax rules and ensuring proper classification of individual assets supports the claim of capital allowances. Withholding Tax remains an area of scrutiny in tax audits, with specific responsibilities for taxpayers to discharge. In this environment of amplified and focused scrutiny, taxpayer stand to benefit significantly from Special Voluntary Disclosure Program 2.0, through proper risk assessment, strategy and good-faith disclosure.
