I chaired the Dialogue which provided the opportunity for Affiliate Members of MBAM from various states to gather under one roof with the purpose of discussing issues affecting the industry.

We requested the Government to ensure that any price increase of construction building materials must be within control and must be fair and reasonable. The Government must consider further liberalizing importation of all building materials. This is in view of the rising inflation and hike in material prices which will increase construction cost. MBAM also urged the Government to also implement import duty reductions for construction machinery equipment. In view of the need for adequate manpower resources to undertake the jobs created under the Economic Transformation Programme and Entry Point Projects (EPP), MBAM hopes the Government will consider relaxing its policies involving construction workers. MBAM hopes that the Construction Labour Exchange Centre Berhad (CLAB) can speed up the work permits of foreign construction workers since the construction industry urgently need workers. We also hope that CLAB will play an important role under the Legalisation and Amnesty Programme announced recently by the Government to legalise the illegal foreign workers to reduce the shortage of manpower in the construction industry.

Another urgent issue which was highlighted to the media during the Affiliate Dialogue was that the Government should consider is to lower the proposed medical insurance which will cost RM120.00/worker even though it is supposed to be borne by the foreign workers. Employers will be required to enclose a copy of the medical insurance policy for the workers when applying for a new work permit or renewing work permits. The amount will definitely be a burden to foreign construction workers and may deter them from deciding to come to Malaysia to work in our construction industry. MBAM also hopes the Government will quickly implement their proposal regarding creating transit centers to house foreign workers. More importantly MBAM would like CLAB to study the impact of labour movement on the Malaysian construction industry when the economic integration of ASEAN countries comes into effect by 2015.

MBAM 57TH ANNIVERSARY DINNER IN AID OF NEW MBAM BUILDING FUND

Minister in the Prime Minister’s Department and Chief Executive Officer, Performance Management And Delivery Unit (PEMANDU), YB Senator Datuk Seri Idris Jala, officiated MBAM 57th Anniversary Dinner in Aid of New MBAM Building Fund on 17th June 2011 at Grand Lagoon Ballroom, Level 15, Sunway Hotel Resort And Spa. The theme was “Leading the Construction Industry through Transformation”. This theme was chosen to reflect our keen commitment in inculcating greater awareness amongst MBAM members on the need to transform our building industry to embrace the need for a more productive and innovative construction industry in Malaysia.

During the event, the late Dato’ Patrick Wong, MBAM Past President and Mr Lai Moo Chan MBAM Past President were both honoured by the Association. In recognition of their exemplary contribution towards the development of MBAM, in particular, and their various contributions to the construction industry in Malaysia as well as globally, the MBAM Council accepted the recommendations in accordance with Rule 10.5 (a) of the By-laws to confer upon the late Dato’ Patrick Wong the MBAM Gold Award and in accordance with Rule 10.5 (b) of the By-laws to confer upon Mr Lai Moo Chan the MBAM Silver Award on this day 17th June 2011.

The Association also recognized the contributions of the Secretariat Staff through the MBAM Service Awards which were given out to En Daipi bin Samad and Ms Lee Siew Mei who respectively were awarded the 25 Years Long Service Award and Silver Award (10 years) while the following companies and individuals received the Bronze Award (5 years):

Fajarbaru Builders Sdn. Bhd.

Cworks System Sdn. Bhd.

Mr John Tong, MBAM Honorary Advisor (Legal)

Mr Lim Chong Fong, MBAM Contracts and Practices Committee Member

Ms Josephine Tan, MBAM Human Resources Committee Member

Mr David Wong, MBAM Human Resources Committee Member

I would like to take this opportunity to thank all MBAM members and their business associates for their continued support by supporting and turning up to celebrate our 57th Anniversary Dinner with us. My thanks also go to our Affiliate Members & fellow professional and trade associations in particular those coming from other states for coming all the way to support us.

A special thanks goes to our Organizing Chairman Mr Oliver Wee and members of his Organizing Committee for the hard work invested to ensure the event a success and last but not least once again I would like to extend my greatest appreciation to YB Senator Datuk Seri Idris Jala, Minister in the Prime Minister’s Department and Chief Executive Officer, Performance Management And Delivery Unit (PEMANDU) for taking the time to be with us.

MBAM ANNUAL SAFETY AND HEALTH CONFERENCE AND SIGNING CEREMONY OF MEMORANDUM OF UNDERSTANDING BETWEEN MBAM AND KLIA COLLEGE

Minister Of Human Resources, Malaysia Yang Berhormat Datuk Dr. S. Subramaniam, officially launched the MBAM Annual Safety and Health Conference 2011 and also witnessed the signing of MOU between Master Builders Association Malaysia (MBAM) and KLIA Professional Management & College (KLIA College) to conduct the MBAM Site Safety & Health Supervisors course for the construction industry on 21st June 2011 at Sime Darby Convention Centre.

The above events will contribute towards enhancing safety management and occupational safety and health practices in the Malaysian construction industry. MBAM has chosen the theme of “Enhancing OSH Performance Beyond Statistics” for this year’s safety conference to create awareness and inculcating safe and healthy work practices in construction work sites beyond just statistics. Another pertinent area is the continuous structured education and training on effective safety and health management and implementation. MBAM is aware that construction will continue to play a vital role in the economic growth of the country, especially in the implementation of projects to be rolled out under the Tenth Malaysia Plan (10MP) and the Economic Transformation Programme (ETP). With the pressure of time constraint for numerous projects to be completed as well as future projects anticipated under the ETP, contractors must ensure that their responsibility and commitment to safety and health must not be compromised.

MBAM has also launched the MBAM Handbook on Safe Crane Operations during this event. This practical ‘MBAM Safe Crane Operations’ hand book will help to educate and provide useful guidance to all construction site personnel dealing with crane operations. With this effort, MBAM hopes that the number of incidents and accidents involving cranes in the construction sites can be greatly reduced.

In order to meet the high demand and serious shortage of Site Safety & Health Supervisors (SSS) in the construction industry, with the endorsement of Department of Occupational Safety & Health (DOSH), MBAM is taking a pro-active step in helping the Government to overcome the above issue by conducting a 10-days SSS training course. This is an industry driven programme tailored for the construction industry and will be Accredited by DOSH.

TALK ON CERTIFICATE OF COMPLETION AND COMPLIANCE (CCC) – LIABILITY ASPECTS ANDINSURANCE RISK TRANSFER SOLUTIONS

The introduction of Certificate of Completion and Compliance (CCC) which replaces the previous CFO has been implemented since 12th April 2007. The rationale of this change is to improve the delivery system and in support of the Government’s desire to encourage self-regulation. An important feature of this change is the “Stage Certification” based on a “Matrix of Responsibility” together with the amendments in legislative provisions, which places the onus on all the relevant parties to ensure speedy and quality delivery. This ultimately means a more transparent view on accountability and thus liability to be assumed by the respective players in the matrix. In assessing the inherent risk profile resulting from this development, MBAM has invited Ms Saw Kheng Lay, Chief Executive Officer / Director of MP Insurance Brokers Sdn. Bhd. to present the available insurance solutions and options that should be considered which might address this situation during a talk on Certificate Of Completion And Compliance (CCC) – Liability Aspects and Insurance Risk Transfer Solutions. This was held at the Kuala Lumpur Golf and Country Club on 26th June 2011 in conjunction with the 57th MBAM Annual General Meeting 2011.

57TH MBAM ANNUAL GENERAL MEETING 2011

The 57th MBAM Annual General Meeting 2011 was held on 26th June 2011 in Kuala Lumpur Golf and Country Club. Members were given a summary of activities that took place in 2010. The following milestones were reported:-

The stamp duty was managed to be reduced to 0.1% ad-valorem on the contract value.

Addressing foreign workers issues by organizing dialogues with various government agencies such as the Construction Industry Development Board (CIDB) and Construction Labour Exchange Centre (CLAB). MBAM will keep members informed on the legalization and amnesty programmes on illegal construction workers in the country.

Submitted Memorandum to the Ministry of International Trade and Industry on reduction of import duty and sales tax for heavy machinery for the construction industry.

Submitted Memorandum on the Construction Industry Payment and Adjudication Act (CIPAA) to PEMUDAH for the speedy enactment of the said act to protect the interest of the industry players.

Liberalisation of Building Materials.

MBAM has developed a resource centre portal which is linked to MBAM website for collation, exchange and dissemination of date and information.

Signing of Memorandum of Agreement with the Institute of Professional Development – Open University Malaysia (IPD-OUM) on collaboration in programmes tailored made for the construction industry as part of MBAM’s human capital development programme.

The AGM had unanimously adopted the minutes of the last AGM and received the Annual Report and Treasurer-General’s Report, the Audited Accounts for the year ended 31st December 2010 and appointed Auditor for the year 2011.

MBAM hopes that members will make an active effort to attend future AGMs as they are also stakeholders in the activities of the Association. In conclusion, MBAM will actively initiate, support and participate in initiatives and activities that enhance professionalism, productivity and quality in the construction industry. The Association will continue to strive to champion issues related to the construction industry to safeguard members’ interest and to enhance their competitiveness.

32nd ASEAN CONSTRUCTORS’ FEDERATION (ACF) MEETING

MBAM Deputy President, Mr Matthew Tee, MBAM Vice President, Encik Aziz Bahaman, MBAM Secretary-General Ir.
