Editor’s Note Greetings from Master Builders Association Malaysia’s Publication Committee. Thank you for picking up this issue 129 of the Master Builders Journal. We have endeavoured to make this issue a good one for the readers, and we hope we have successfully achieved that goal. We are now in the last stretch of 2023. It has been an eventful year for Malaysia and for the Malaysian construction industry. For Malaysia, it will soon be a year under the able leadership of Prime Minister YAB Dato’ Seri Anwar bin Ibrahim. For the Malaysian construction industry, it is another tough year, with the industry still reeling from the effects of the pandemic as well as the war in Europe. We hope the government can continue to take action on feedback from the industry in order to drive the industry forward and for the construction industry to continue to be the driver of growth for the nation. The Malaysian construction industry is undeniably a contributor to global warming, including by using old construction machinery that was not designed with its impact on the environment in mind. However, companies are now more conscious and aware of the environmental impact of their activities and are willing to invest in being more environmentally friendly. In this issue, Master Builders Journal takes a look at machinery companies and their efforts to introduce products that are more environmentally friendly. Mediation is a highly effective way to resolve conflicts and disputes. It provides a platform for open and honest communication, allowing parties to express their concerns, needs, and interests. Mediation also empowers participants to have control over the outcome. Instead of having a decision imposed upon them by a judge or arbitrator, parties in mediation work together to find mutually agreeable solutions. Master Builders Journal talks to a number of MBAM Council Members to find out why they prefer mediation over other methods to resolve disputes. Ooi Shi Qing MBAM New Members New Members as at 20 th October 2023 About MBAM The Master Builders Association Malaysia (MBAM) plays an important role in the development and advancement of the construction industry. For the past few decades, we have represented Malaysia’s construction industry as its voice during various key phases. Dedicated towards promoting and developing the construction industry in Malaysia, MBAM has evolved into a cohesive umbrella organisation. We have earned international recognition through our affiliations with the International Federation of Asian and Western Pacific Contractors’ Associations (IFAWPCA) and the ASEAN Constructors Federation (ACF). We have also successfully hosted the 20 th , 29 th and 44 th IFAWPCA Conventions in 1983, 1998 and 2018 respectively. Through the memberships in IFAWPCA and ACF, the MBAM members are part of the international construction fraternity. MBAM is also a member of The Building Industry Presidents’ Council (BIPC), where members comprise of Presidents from Pertubuhan Akitek Malaysia (PAM), The Institution of Engineers Malaysia (IEM), Association of Consulting Engineers Malaysia (ACEM), Real Estate and Housing Developers’ Association (REHDA), Malaysian Institute of Planners (MIP) and Royal Institution of Surveyors Malaysia (RISM). The formation of BIPC is a quantum leap in terms of cooperation among the industry players in the country to look into the interest of the construction industry from a wide spectrum of trades. MBAM members are also from entities that are directly and indirectly linked to the construction industry. This includes specialist sub-contractors, building material suppliers, manufacturers and trading companies. With both local and international presence, MBAM is well poised to effectively represent the Malaysian construction industry as a single, unifying voice to the relevant government authorities as well as various organisations and bodies.14 MASTER BUILDERS JOURNAL #129 From the Desk of Oliver HC Wee MBAM President CIDB Initiatives The Construction Industry Development Board (CIDB) Malaysia has introduced two initiatives that contractors have welcomed with open arms and hailed as game changers. CIDB rolled out its latest CIDB Standard Form of Contract with its first roadshow in Penang on 7 August and also, a few days later, granted a letter of approval that accredited the CIDB Construction Mediation Centre under MBAM. The letter that MBAM received marked a historic milestone for MBAM, which celebrated its 69th anniversary this month. It is a ‘badge of honour’ that MBAM is proud of, a testament to MBAM’s continuous effort as the prime mover and the recognised voice of the Malaysian construction industry. The two initiatives are primed to transform the dynamics of the construction industry and promote sustainable growth. CIDB has put in place early warning systems to avert disputes and mediation provisions to ensure the sustainable growth of the industry. The scale of disputes has been still high and mounting, while the quantum of disputed claims has already breached the billion-ringgit mark. According to the Asian International Arbitration Centre (AIAC) statistics, for 2022–2023 alone, there are over RM1.6 billion in claims from disputes. NEW CIDB Standard Form of Contract: Adversarial vs. Collaborative The CIDB Standard Form of Contract for Building Works 2022 will have a significant impact on the construction industry’s practices and procedures to enhance contractual practices and project delivery in the construction sector. It has clauses to enhance dispute avoidance with built-in early warning systems that will help to reduce the number of disputes by giving all parties an opportunity to address issues and stop them from escalating further through the provision of a Dispute Avoidance Board to assist the contracting parties. A notable feature of the contract is that all stakeholders will be proactive, and they are tasked with administering their projects jointly, whereas before they tended to be adversarial as meetings were between the contractors and consultants. Now clients and contractors will have to collaborate through regular meetings and will always be updated and on the same page whenever new claims arise. The contract will help to plug many unwanted leakages and help with governance matters such as keeping corruption in check. Through the use of this new contract form, we hope contractors can look forward to better cash flow, minimise cases of projects being abandoned, and avoid costly legal fees. MBAM believes the use of the new CIDB contract form is a sustainable way to manage contractual relationships, and hopes this game changer will help to reduce the number of abandoned or “sick” housing projects in the country. MBAM would like to commend CIDB for its efforts in formulating the new contract form, which has taken into account claim disputes and cash flow issues affecting contractors. For a start, MBAM Council members, who collectively represent 80% of the ‘big-time’ contractors here, have pledged to give priority to mediation to resolve any disputes. The CIDB mediation centre will provide mediation services and also conduct training and education programmes on mediation. Since MBAM has already launched our mediation services in 2018, we reckon the industry stakeholders have to closely work together for the common good, especially with the challenges post-COVID-19. Only a concerted effort to collaborate to effect change will yield positive results for our beloved construction industry. Recognizing the need for a more sustainable future, there is a crucial shift toward incorporating green machinery in construction. In order to understand this transformative process, MBJ engaged in conversations with key stakeholders to gain valuable insights. Can you explain to our readers your company's objectives and initiatives for the above? It’s a great honour to be recognised by MBAM, and we do pride ourselves as a leader in sustainability and green transition. It’s worth mentioning that improving working conditions, safety, and performance worldwide while protecting people and their environment has been a long-standing mission statement of Manitou Group. The group’s employees and stakeholders all play an active role in this plan; it’s consistent with the Manitou Group strategic plan “New Horizons 2025” and the dynamic initiated towards a sustainable business model. This philosophy is also conveyed by the group’s signature, “Set the world in motion”, indicating the desire to always do better, become the actors of change, and contribute to the world in motion. Engaging our teams and stakeholders on a shared sustainable path What are the challenges that your company has faced on this journey? Manitou started as a humble construction company in 1945, and we produced our first material handling equipment in 1958. Today, we have sold a million machines worldwide, with 80% of our sales occurring outside of France. We understand that awareness and maturity regarding sustainability concepts vary. Different countries and continents may have their own interpretations of sustainability. At Manitou, we strive to create a humane and ethical company with three major components: circular economy, low carbon trajectory, safety, and improved working conditions. In recent years, Manitou Group has made significant R&D investments to electrify our internal combustion equipment as part of our green transition effort. However, the ecosystem needed to support such initiatives has yet to be fully established. While our equipment is most commonly used in the construction industry, there needs to be more infrastructure for generating sustainable electricity to power it regularly. We recognise that this cannot be changed overnight and that it will take time. Nevertheless, as leaders, it's our responsibility to take this leap of faith.
