Greetings and salam sejahtera to our dear readers, Welcome to this Master Builders Journal (MBJ) Issue 123 Vol.3/2021. To begin, I am excited to inform you that for the first time in MBJ history, this edition is being published simultaneously online at the MBAM website and in the traditional physical form – still available at most reputable bookstores – to cater to as many of our readers’ preferences as possible, and we look forward to your continued support for both formats. As we end the final quarter of 2021, we can all finally heave a collective sigh of relief as the national vaccination rates – and booster shots – continue to allow the economy to open up while keeping infection rates stable and controlled. While new COVID-19 variants still pose a concern, our sustained practice of the new norms, particularly in the construction industry, remain the most effective way of balancing a return to normality and preventing a devastating new wave of infections. The latest challenge facing our construction industry now revolves around the severe labour shortages due to a continuous exodus during the strict lockdowns of the past two years, and MBAM is actively engaging the government to come up with mutually beneficial and cost-effective ways of resolving it. In this regard, the construction industry has always welcomed the infusion of fresh talent and skilled workers, particularly locals, into its ranks, and we are fortunate that many public and private institutions exist to lay the groundwork for this talent pipeline. Our tertiary vocational and academic tracks are well established, from GIATMARA and Akademi Binaan Malaysia, to the various polytechnics and universities offering construction- relevant courses, but what needs to be improved is a continuing evaluation of these institutions’ output and expectations to match the evolving and dynamic needs of the construction industry. There are also procedural inconsistencies that require immediate attention, such as the differences in accreditation by the National Occupational Skills Standards (NOSS) Division and that of the Construction Industry Development Board. Our best hope lies in the development of a comprehensive whole-of-society approach matched with a future-centric outlook, with all stakeholders represented and involved in long-term decision-making. As such, this issue shines a spotlight on the young ones just entering the industry – the fresh graduates who earned their bachelor’s degrees at local universities with the assistance of MBAM Scholarships, and features an article contributed by our long time Work-Based Learning partner, Politeknik Ungku Omar (PUO), which is the oldest polytechnic in the country. We have a number of contributed articles for our readers, covering a variety of topics ranging from an overview of current ESH practices, commentaries on mediation as an alternative form of construction dispute resolution, issues relating to CIPAA adjudications and suggestions on how to properly document a bona fide retrenchment exercise. We sincerely hope that you will enjoy reading the materials and gain insights from this issue as much as we have enjoyed producing them. As we move into the first quarter of 2022, I hope there will be more collaborations and further engagements with you, our loyal readers. For the past few decades, we have represented Malaysia’s construction industry as its voice during various key phases. Dedicated towards promoting and developing the construction industry in Malaysia, MBAM has evolved into a cohesive umbrella organisation. We have earned international recognition through our affiliations with the International Federation of Asian and Western Pacific Contractors’ Associations (IFAWPCA) and the ASEAN Constructors Federation (ACF). We have also successfully hosted the 20 th , 29 th and 44 th IFAWPCA Conventions in 1983, 1998 and 2018 respectively. Through the memberships in IFAWPCA and ACF, the MBAM members are part of the international construction fraternity. MBAM is also a member of The Building Industry Presidents’ Council (BIPC), where members comprise of Presidents from Pertubuhan Akitek Malaysia (PAM), The Institution of Engineers Malaysia (IEM), Association of Consulting Engineers Malaysia (ACEM), Real Estate and Housing Developers’ Association (REHDA), Malaysian Institute of Planners (MIP) and Royal Institution of Surveyors Malaysia (RISM). The formation of BIPC is a quantum leap in terms of cooperation among the industry players in the country to look into the interest of the construction industry from a wide spectrum of trades. MBAM members are also from entities that are directly and indirectly linked to the construction industry.
