DAY 1 : 31ST OCTOBER 2017 (TUESDAY)
TALK ON FOREIGN WORKERS’ LIABILITY TO PAY INCOME TAX
9.30 a.m. – 11.00 a.m.
Under Section 7 of the Income Tax Act (ITA), a foreign workers become liable to pay income tax when he is deemed a resident after having been in Malaysia for 182 days or more. It is further noted that effective August 2017, Employers are required to perform Monthly Tax Deductions (MTD) for employees with foreign nationalities (employment contract exceed 182 days beginning from its effective date) based on current published rates of local workers/ workers with permanent resident, failing which the Employer will be subjected to penalties provided under the Income Tax Act 1967.
Most of MBAM members are not aware of the above ruling and thus do not perform MTD for their foreign worker employees. All foreign workers engaged in the construction industry consists of general workers where levy is paid on a yearly basis to the Department of Immigration Malaysia.
MBAM has invited representative from the Inland Revenue Board Malaysia (LHDN) for a briefing session to highlight the necessary actions required by the Employers with regard to the above ruling.

TALK ON JTK’S REQUIREMENTS FOR RECRUITMENT OF FOREIGN WORKERS
10.30 a.m. – 1.30 p.m.
The Ministry of Human Resources (MOHR) and the Construction Industry Development Board Malaysia (CIDB) are currently working closely in updating the “Minimum Standards for Workers’ Housing and Facilities Act 1990 (Act 446) in line with the MOHR’s effort to synergize the minimum standards allowed for workers housing and facilities across all sectors in Malaysia.
The purpose of talk are:
- To create awareness among members on the latest JTK’s requirements for the recruitment of foreign workers in the construction industry. (including the new requirement for workers’ accommodation).
- To create a platform for MBAM members to raise queries on other issues arises when dealing with CIDB or JTK on this matter.
