NOTICE OF OPERATION OF THE OCCUPATIONAL SAFETY & HEALTH ACT (AMENDMENT) 2022 & FACTORIES & MACHINERY ACT (REPEAL) 2022
In exercise of the powers conferred by subsection 1(2) of the Occupational Safety and Health (Amendment) Act 2022 [Act A1648], the Minister of Human Resources Malaysia has appointed 1 June 2024 as the date on which the Act had come into operation. We wish to note that under the Section 29A of OSHA (Amendment) 2022, it has provided that all employers in the Small & Medium Industry (SME), who are having 5 or more employees, are required to appoint at least one of their employees as the OSH Coordinator to coordinate on the issues related to OSH at place of work. Any offense under Subsection 29(1) may result in the employer being fined up to fifty thousand ringgit (RM50,000) or being jailed for up to six months, or both.
