Chong explained that a commercial organisation commits an offence if a person associated with the commercial organisation corruptly gives, agrees to give, promises or offers to any person any gratification, whether for the benefit of that person or another person with the intention to: (a) obtain or retain business for the commercial organisation or (b) obtain or retain an advantage in the conduct of business for the commercial organisation. If convicted of an offence under s.17A(1), it is liable to a fine of a minimum of ten times the sum or value of the gratification or RM1 million, whichever is higher, or imprisonment of a maximum of 20 years, or both. Head of Programme, Dr Mimi Faisyalini Ramli briefed on the programme structure, planning, and timeline for WBL implementation for the new Bachelor of Engineering Technology in Rail Transportation after recapping the essence of the MOU. There was an open discussion on potential collaboration with MBAM. Other occupational risk matters were also brought up for discussion, for students who will undergo internship. The committee encouraged UTHM students to join the MBAM Graduate Alumni and invited the academicians to contribute articles for the Master Builders Journal. The Minister in the Prime Minister’s Department had issued guidelines in December 2018, which covered five principles (TRUST): T – Top Level Commitment R – Risk Assessment U – Undertake Control Measures S – Systematic Review T – Training and Communication An organisation must conduct periodic corruption risk assessments to establish appropriate processes, systems and control and to mitigate specific corruption risks, including the implementation of ISO 37001(2016). However, it is recommended that parties concerned should test them against the steps recommended by the guidelines and to supplement if the standards do not include the guidelines recommended. The objective of the seminar was to increase awareness on Industry4WRD- related incentives, such as Readiness Assessment, Intervention Fund, Domestic Investment Strategic Fund (DISF) and Automation Capital Allowance (ACA). In response to the Fourth Industrial Revolution (Industry 4.0), the Industry4WRD: National Policy on Industry 4.0 was launched on 31 October 2018 to drive digital transformation of the manufacturing and related services sectors in Malaysia. Trained assessors will help applicants understand their readiness for Industry 4.0 and make recommendations on where to start transformation. The benefit of this process is mainly to identify areas of improvement in terms of people, process and technology. The applicant will also receive a comprehensive readiness report and be entitled for financial incentives. MITI is targeting 450 small and medium enterprises (SMEs) to undergo the government-funded national policy on Industry 4.0 (Industry4WRD) Readiness Assessment (RA) programme this year. Last year, 508 SMEs were selected out of 849 applications to undergo the programme. YB Dr Ong said the programme aimed to help SMEs assess their readiness for Industry 4.0. The government has allocated RM43 million for Industry4WRD-related programmes. For more information, please refer to www.mida.gov.my.30 MASTER BUILDERS JOURNAL #118 11 FEBRUARY 2020 Consultation Session with Industry Players on the Impact of Coronavirus to the Industry/Economy Concern on the impact of COVID-19 on the economy prompted the Ministry of International Trade and Industry (MITI) to hold a consultation session at MITI Tower. In his welcome speech, Deputy Secretary-General (Industry), Dato’ Sri Norazman Ayob said that the purpose of this session was to obtain feedback on the impact of COVID-19 to the industry/economy and to obtain suggestions on measures that the government could implement. The suggestions will then be proposed to the Ministry of Finance (MOF) and Ministry of Economic Affairs (MEA) for their consideration. The first session was a presentation by Zafri Zulkeffeli from Malaysian Industrial Development Finance (MIDF), who shared the impact of COVID-19 on the world and mentioned that Malaysia is among the main countries to experience significant slowdown in the event of weakening household expenditure in China. Among the sectors affected are electrical and electronics, food and beverage, chemical and agriculture products. During the consultation session, representatives expressed the difficulties and the problems they faced during the Covid-19 outbreak and provided suggestions on measures the government can implement to overcome the situation. Dr. Priya a/p Ragunath from Disease Control Division, Ministry of Health presented some information and statistics of the COVID-19 outbreak, preventative measures, as well as the management and control of the disease outbreak by MOH. Representatives from more than 20 associations and organisations attended the event. At the request of MITI, MBAM issued a circular to its members on 13 February requesting for feedback on the impact of COVID-19 on the construction industry/economy. Deputy Director General (Control) of Immigration Department of Malaysia Dato’ Abdul Halim Haji Abdul Rahman delivered the welcoming remarks. The participants learned of the mandatory requirement on the accreditation of new foreign workers at the source country before entering Malaysia, which commenced on 1 January 2020. “The requirement is under Section 33A(1) of CIDB Act 520”, explained Senior Manager of CIDB Holdings Sdn Bhd, Nazri Noordin when he presented ‘The Implementation of Accreditation of Skill Construction Workers at Source Country’. CIDB established the Construction Skilled Worker Management System (CSWMS) to manage the recruitment and training requirement compliance of foreign workers. Dr Azmi Abdul Rahim from Ministry of Health Malaysia shared the statistics of the health screening recorded by MOH during his presentation on ‘Foreign Workers Medical Examination’. He stressed the importance of health screening that is to be conducted before foreign workers are allowed to work in Malaysia. Chief Executive Officer of FOMEMA, Dr Hj Ridzal Mohd Zainal, who was also a speaker, told the participants that with effect from 31 January 2020, FOMEMA will inform Immigration Department of Malaysia (or JIM) on the results of foreign workers who failed the medical examinations. The employer will receive an email from FOMEMA and a letter from JIM. Those who fail the medical examination are to return home via Checkout Memo (COM). The results of the medical examination will be processed within ten working days and the appeal process is allowed within two weeks upon receiving the official results. No appeal will be entertained for those who failed the medical examination for tuberculosis, malaria, syphilis and pregnancy. Prosecution Unit Head of Immigration Department of Malaysia, Kasthuri Bai Venugopal spoke on ‘Law and Enforcement towards Illegal Foreign Workers – Issues & Challenges’. In response to one question from the participant, she emphasised that written approval from JIM must be obtained for mobilisation of the workers and cross sectorial mobilisation is not allowed as it is under the purview of Ministry of Home Affairs and not under JIM. She also gave the statistics of illegal foreign workers caught and the fines collected during the enforcement period in 2018. Tuan Mohammad Abiddin Abd Rahman of Foreign Worker Division of Immigration Department of Malaysia elaborated on JIM’s new system ie ePLKS@JIM System, which was launched on 2 December 2019. The system allowed the renewal of permits, payments and notifications to the employer to be done online without the involvement of a third party or agent. The distribution of the stickers is processed by the immigration state office. A dialogue session with Director General of Immigration Department of Malaysia, Dato’ Indera Khairul Dzalmee Daud was held in the afternoon. In response to one question raised, he mentioned that those having valid documents to work and were arrested by police are to write to him officially. JIM and the police are working together to avoid such incidents. After summation of the presentation papers in his closing remarks, Dato’ Indera Khairul urged all parties to work hand-in-hand with JIM to find the best solutions in managing foreign workers in Malaysia. He stressed on the rules of law and informed that i-Kad (an identification card system) will be re-introduced by the government in two to three months’ time to control the influx of illegal foreign workers.33 MASTER BUILDERS JOURNAL #118 Council members Industry & Practices IP 14 FEBRUARY 2020 Seminar on Industrial Relations (Amendment 2019) Act 177 Deputy Director-General of Industrial Relations, Ministry of Human Resources (MOHR), T. Shanmugam explained the objectives and areas of amendments during his presentation on the Industrial Relations Act 1967. The recent amendments were part of the holistic review and to a certain extent, conforms to international obligations in bringing transformation to the industrial relations landscape in the country. The amendments were passed by the Senate on 19 December 2019. The seminar, which was hosted by the Federation of Malaysian Manufacturers at the Sime Darby Convention Centre was attended by HR Committee member Mazlan Haron. In his presentation, he informed that the Minister of Human Resources’ power to refer representations on dismissal cases to the Industrial Court is replaced by the Director-General for Industrial Relations (DGIR) to expedite the process. Cases that are not resolved through conciliation at Department of Industrial Relations Malaysia (DIRM) will automatically be referred to the Industrial Court. This allows the Industrial Court to continue its proceedings when a workman dies and to allow back wages or compensation to be awarded to his next of kin. The employer or worker may be represented by any person of their choice, except lawyers, during the conciliation process at DIRM. Workers with mental disabilities who do not have guardians may be represented by their next of kin at conciliation proceedings, subject to the approval of the High Court. The amendments allow any persons dissatisfied with an award of the Industrial Court to appeal to the High Court within 14 days upon receipt of the award. In enhancing the recognition process, the Minister’s power to decide on matters relating to capacity and recognition issues involving trade unions is replaced by the Director-General of Industrial Relations (DGIR) to expedite the claim recognition process. This means that the recognition process involves two departments, namely DIR and Department of Trade Unions Affairs, which now lies under the purview of DIR only. The amendments also covered the sole bargaining rights of the workmen to choose the preferred trade union in the event that there are more than one recognised unions representing them in collective bargaining in an organisation. Trade unions of workmen will now be allowed to raise questions of general character relating to transfers, employment, termination of services due to redundancy, dismissal and reinstatement, and assignment or allocation of work. Other amendments were on the reduction of the list of Essential Services (First Schedule), removal of imprisonment sentence for unlawful pickets, strikes and lock-outs, increased penalty for offences and the imposition of an interest rate of 8% per annum or lesser as the court may direct. MBAM was represented by Education & Special Institutions Deputy Chairman II, Andrew Ong, as the CIDB CCM Programme Panel assessor. Six candidates were interviewed by three panel assessors appointed by CIDB. The certification and accreditation of Construction Managers through the CCM Programme is to comply with the Construction Industry Competency Standard (CICS). Section 33(1) provided that a person shall not be involved as a construction personnel unless he registered and holds a valid certificate of registration. Under Clause 33(4) of the CIDB Act 520 (Amended 2011), it is stated that a person who contravenes this subsection (1) shall be guilty of an offence and shall, on conviction, be liable to a fine not exceeding five thousand ringgit. The objectives of the CCM programme is to ensure the project is efficiently and effectively carried out within the stipulated cost and timeframe and the quality of construction. There are 17 learning modules under this programme with three methods of assessment. The first method is training and assessment, where the method of delivery is through lectures that included Knowledge Assessment (KA) and Practical Assessment (PA). The second method is assessment only, where the participant is required to answer questions within a timeframe. The third method is qualification through experience and education background, where a participant undergoes professional and portfolio assessments based on experience, knowledge, skills and attitude in the construction project management field. The participant must provide documents evidencing the relevant working experience (source: CIDB). The accreditation programme and framework of CCM was presented to the academicians and the construction industry players on 5 February 2020 at Universiti Kebangsaan Malaysia, Bangi. MBAM Vice President cum HR Committee Chairman, Dennis Tan highlighted the importance of getting accredited and to comply with the CIDB Act 520 in his speech. A certified construction manager is required for projects valued at RM50 million and above by year 2023. The CCM briefing was also held on 24 February 2020 at Universiti Tun Hussein Malaysia, Pagoh, Johor where representatives of MBAM affiliate members, The Johore Master Builders Association and Malacca Building Contractors Association attended the briefing. At the request of CIDB Wilayah Persekutuan Kuala Lumpur State Director, Zainora Zainal to disseminate information regarding the CCM programme, the briefing was held for MBAM Council members on 28 February 2020. The session was officiated by the Secretary-General of the Ministry of Works, Dato’ Dr Syed Omar Sharifuddin Syed Ikhsan. 2 DECEMBER 2019 InBrief 11 FEBRUARY 2020 DOSH Selangor Meeting on Improvement for Concreting Works at Construction Sites The meeting at DOSH Selangor advised those present to comply with the latest Request for Information (RFI) on Concreting for the purpose of reducing construction accidents, such as the collapse of a building under construction at site. The enforcement unit is tasked to check concreting works and related activities at construction sites in Selangor. The objective of setting up the DEPA fund is to stimulate the export of construction and construction- related services and supplies through a framework of providing financing solutions for qualified overseas construction projects. The professionally-managed fund aims to ease access to equity financing by providing a platform where key construction industry players in the private and public sectors work together to fund overseas construction projects based on commercially beneficial terms. Thus, the DEPA will raise funds from Government-linked investment companies (GLIC) and the bond market to provide equity financing for qualified overseas construction projects. The role of the fund is to invest in overseas construction projects and supports up to 30% equity funding. The first stage of the DEPA Programme will be coordinated by CIDB. It is targeted to be rolled out by Q2 2020 and launched during the International Construction Week (ICW 2020). The framework for implementation of the programme will be developed and require further syndicated engagements with GLICs to review the projects for direct investment opportunities. Amongst the GLICs included are the Employees Provident Fund, Khazanah Nasional Berhad, Perbadanan Nasional Berhad and Kumpulan Wang Persaraan. The programme will provide options for participating GLICs to invest in qualified overseas construction projects vide equity and/or mezzanine financing. 5 DECEMBER 2019 Ministry of Human Resources (MOHR) Town Hall The MOHR town hall session was held at Renaissance Hotel Kuala Lumpur and was attended by MBAM HR Committee Member, Mazlan Haron with secretariat staff. The session started with the presentation, ‘Twelfth Malaysia Plan (12MP) Strategy Paper – Inclusive Labour Market for Prosperous Nation’ by Secretary-General of MOHR, Dato’ Amir Bin Omar. This was followed by a focus group discussion (FGD), which covered: (i) the Twelfth Malaysian Plan (12MP), (ii) Code of Conduct for Industrial Harmony (COC), (iii) National Human Resources Policy and (iv) National Labour Advisory Council (NLAC). The 12MP Focus Group was led by Director-General of Labour Department of Peninsular Malaysia, Dato’ Jeffrey Joakim. Later that afternoon, a dialogue session with Minister of Human Resources Malaysia, YB Tuan M. Kulasegaran and Deputy Minister of Human Resources Malaysia, YB Dato’ Mahfuz Bin Omar was held. All groups presented the outcomes of their discussions during the FGD.37 MASTER BUILDERS JOURNAL #118 5 DECEMBER 2019 Focus Group Dialogue (FGD) on Educational Institutions’ Readiness In Facing IR4.0 10 DECEMBER 2019 Meeting Between MBAM, BMDAM, Beijing Xiaolan Technology Co., Ltd and Putra Nilai Development Sdn Bhd Master Builders Association Malaysia (MBAM) and its affiliate member, Building Materials Distributors Association of Malaysia (BMDAM) held a dialogue at the request of Beijing Xiaolan Technology Co., Ltd and their Malaysian partner Putra Nilai Development Sdn Bhd. Held at the MBAM, the objectives of the meeting were to understand the supply chain model, the ‘World Steel Mall’ (WorldSteelMall) platform developed by Beijing Xiaolan Technology Co., Ltd and its implications to the domestic market. The model is based on the concept of a one-stop centre that trades in iron and steel products by creating volume and hence, economies of scales. Other benefits are online live inspection of the products, confirmation of product standards, and reduction in logistics costs, which will result in cost savings for the buyers. In summary, it is a E-commerce platform with many factories and trading nations under its umbrella, following the one belt one road nations. MBAM and BMDAM highlighted several issues in the local market, such as tariff and non-tariff barriers, anti- dumpling act, safeguard duty, CIDB’s Certificate of Approval (COA), legal issues and after sales service, which was duly noted by representatives of Beijing Xiaolan Technology Co., Ltd. Conducted by MIGHT to study educational institutions’ readiness in facing IR4.0 on behalf of the Ministry of Education Malaysia (MOE), the meeting served to provide key inputs and recommendations to the Ministry in developing the MOE’s Action Plan for IR4.0. The inputs are critical to enable MOE to assess the level of readiness of Malaysian educational institutions in implementing the strategic initiatives of IR4.0, to prepare our young talents. Various industry players expressed their views and challenges faced by them. The main question of ‘Are we all ready to face IR4.0 or rather, is the country ready?’ were passionately debated at the meeting. All valuable thoughts were recorded for future focus group discussions.
